Every Spring & Fall these consignment auctions are some of everyone's favorites. They are usually a day full of quality equipment and auction action featuring heavy construction equipment, Agriculture equipment, attachments & implements, recreational equipment, trucks & trailers of all sizes & variety, specialty equipment, and so much more. Ring 1 will feature live and online bidding starting at 9am and Ring 2 will sell live only beginning at 12pm. We will have 3 great food vendors serving up breakfast, lunch, dinner, & snacks, so plan to come spend an awesome auction day with us. We look forward to seeing you all!

AUCTION TERMS & CONDITIONS
-This auction will be conducted LIVE with ONLINE BIDDING provided by BidWrangler & EquipmentFacts.
-All sales are final & items are sold "as is, where is".
PAYMENT
-Cash, check (with bank letter of credit for this auction & our auction company), cashier's check, or wire transfer are accepted forms of payment. Wire Transfers will need to include a $25 wire transfer fee.
-All items must be paid for in full before they are in the buyers possession.
-By registering to bid on any item, bidder agrees to all terms & conditions of the auction. Kail Auctions, LLC reserves the right to refuse to accept bids or approve bidders for any reason.
-If payment has not been received at auction end or other payment arrangements have not been made by end of business hours on pick upday, we reserve the right to cancel any unpaid item(s) after that time. At this time, we will ban the bidder from any future sales & resell the item(s) to the back up bidder.
-Shipping will only be arranged after payment has cleared.
-On the fall of the auctioneer's hammer or other acknowledgment of a successful bidder on a lot, title to the property in that lot will pass and the successful bidder there upon assumes full risk & responsibility for the purchased property. The highest bidder shall be the buyer. If any dispute arises, the auctioneer shall have absolute discretion to settle it & put any disputed lot up for sale again. Kail Auctions, LLC has full discretion to refuse any bids.
SHIPPING
-If a buyer needs shipping, the buyer is responsible for arranging shipping & having it picked up before Wednesday, November 4th, 2026 @ 5PM CST. If your items are not picked up & have to be removed from the auction site by the auction staff, there will be an additional handling fee of $50 per item due when you pick them up.
ONLINE BIDDING
-Online bidding is a convenience offered to customers & while we make every effort to execute your instructions regarding your online bids, Kail Auctions, LLC is not liable or responsible for any errors or failure to execute such instructions.
-Kail Auctions, LLC reserves the right to cancel, postpone, or extend the auction at their discretion.
DESCRIPTIONS
-All descriptions are subjective & up for interpretation. Please note, buyers are responsible for looking at all photos & reading descriptions. We offer preview time for in-person inspection of the items being offered for auction.
TECHNICAL PROBLEMS
-We have made reasonable efforts to provide for online bidding for this auction. You recognize & acknowledge, however, that technical problems with hardware, software, or internet connectivity, as well as human errors, may arise & may affect, without limitation, the Kail Auction's BidWrangler website, our online bidding program & process, your or our internet service & access, & your connection to this auction's bidding program & process. You further acknowledge that these & other technical problems may develop at any time & with or without notice. You acknowledge & agree that neither we nor the seller is in any way responsible for any such technical problems, and the you have no absolute or other right to be able to bid on this auction in the event of any such technical problems. Notwithstanding the foregoing, you further acknowledge & agree that, in the event of any such technical problems, we reserve the right to postpone or cancel the auction and/or extend the bidding time for this auction and/or relist the property for auction at another time, in our sole discretion, and that our decision with regard to any such actions is and will be final.
All legal disputes or any litigations that may arise, for any reason, between Kail Auctions, LLC and the bidder shall be tried in the Courts of Paris, Henry County, Tennessee. Successful purchasers agree to pay any and all reasonable attorney's fees & costs incurred by Kail Auctions, LLC, the seller and/or their assigns, agents or employees in the commencement or defense of any action here-under as well as in the collection of any obligation here-under.
This auction is being conducted under appropriate state & local laws & the Uniform Commercial Code. Any additional terms or conditions of sale shall be announced prior to the auction. Bidding on any item indicates acceptance of these terms & conditions.
